Data Processing Agreement
The Agreement is concluded in German and only the German version is binding. The PDF below is the informational English translation; the German original is linked beneath it.
The DPA governs how Platte processes the personal data you bring into your dedicated instance – based on Art. 28 GDPR and the model texts of the German data protection supervisory authorities, adapted to the Platte platform. It is an annex to the GTC and applies between Platte as processor and you as controller.
What the Agreement covers
- Subject matter, duration and scope of the processing, types of data and data subjects (Annex 1)
- Technical and organisational measures under Art. 32 GDPR (Annex 2)
- Sub-processing relationships and the list of the sub-processors engaged (Annex 3)
- Instruction and audit rights, notification of breaches, and return and deletion of the data after the end of the contract
Scope of application
The DPA applies to the dedicated instance in the Platte Managed Cloud. In the case of self-hosting under § 6 of the GTC you process the data in your own infrastructure and are yourself the controller – the Agreement does not apply then, to the extent Platte has not taken over operation as a managed service.
